Propty is not a bank, mortgage lender, broker-dealer, law firm, accounting firm, real estate brokerage unless explicitly stated, or fiduciary acting on your behalf, and does not provide investment advice.
Any financing, lending, legal, title, escrow, insurance, or investment-related services may be provided by independent third-party providers subject to separate agreements.

Propty is not responsible for third-party services, their availability, their decisions, their actions or omissions, or any losses arising from third-party relationships.

You retain ownership of information and documents you upload ("User Content").
By submitting User Content, you grant Propty a worldwide, non-exclusive license to store, process, transmit, display, and use such content solely for providing and improving the Services.
You represent that you own or control the necessary rights to the User Content and that your User Content does not violate applicable laws or third-party rights.
We may remove content that violates these Terms.
Violation of this section may result in immediate termination and potential legal action.

All platform content, software, branding, logos, designs, workflows, and materials provided by Propty are owned by Propty or its licensors and protected by applicable intellectual property laws.

"Propty" and associated branding are property of Propty Holdings LLC.

We do not guarantee continuous availability, error-free operation, specific transaction timing, platform uptime, or compatibility with all devices or jurisdictions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
PROPTY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.
WE DO NOT GUARANTEE ANY INVESTMENT OUTCOME, PROPERTY PERFORMANCE, FINANCING APPROVAL, OR RETURN.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPTY SHALL NOT BE LIABLE FOR INDIRECT DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR INVESTMENT LOSSES.
OUR TOTAL LIABILITY ARISING FROM THE SERVICES SHALL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID TO PROPTY IN THE PRIOR 12 MONTHS.
You agree to indemnify and hold harmless Propty Holdings LLC and its affiliates, officers, employees, contractors, and partners from claims, liabilities, damages, losses, and expenses arising from your use of the Services, your violation of these Terms, your violation of applicable laws, or your infringement of third-party rights.
We may suspend or terminate access to the Services at any time and without prior notice if you violate these Terms, we suspect fraud or illegal activity, or termination is required by law or compliance obligations.
You may stop using the Services at any time.
Certain obligations survive termination, including indemnification, limitations of liability, and dispute resolution provisions.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in the State of Florida, except where prohibited by law.
You agree to waive jury trial rights and participation in class actions or class arbitrations.
You may pursue eligible claims in small claims court.
We may update these Terms periodically.
Updated Terms become effective upon posting to the Services.
Continued use of the Services after updates constitutes acceptance of the revised Terms.
